I don't think it's a hangover from the previous maximum speed that you could get because under The Legal Stuff, subsection Volt benefits: it also states, "Doesn’t include Upload speed add-on;"
"Volt benefits: Volt benefits available if you have or sign up to both an eligible Virgin Media broadband service and an eligible O2 Pay Monthly tariff. Excludes Essential broadband customers from 10 November 2022. Volt benefits include (1) Virgin Media broadband speed boost to the next available level (up to a max of 1Gbps download speed) at the point you place your order to become supercharged with Volt. You either 1) have to be in a Nexfibre wholesale area, or in a Virgin FTTP area (not HFC or RFoG). In other words you have to have a Hub5x connected directly to the fibre infrastructure to go on 2Gig.

I would say if you are now paying for 1Gb/s fully (on whatever deal you haggled) ie. did not use Volt to get from 500Mb/s to 1Gb/s then you should be able to unless they change the rules.
