I am a live streamer and had the 350 package which i found my upload speed being erratic and my livestream kept lagging. called virgin media and they advised me to upgrade to the 1gb connection which i did and after a few days started to see the same problem with my upload speed. after many phone calls to virgin media they have now said that my upload speed is being throttled! so what a waste of money since i upgraded to the top tier internet. con

They are talking out of the wrong end to get you off the phone.

So what is your upload speed showing by speed test sites?
VM do have the ability to throttle which might be down to the limited upstream that you and others are causing problems for others for high pings
limit your bit rate streaming

my upload is fluctuating it should be 104 upload but im getting low upload speeds where it will end my stream

im also streaming at 6000 bitrate which is only 1920x 1080 not full 4k

Did you actually do the realspeed test as asked? I also wouldnt expect congestion to end your stream, just to cause buffering instead.
As said VM dont throttle.

VM won't deliberate apply throttling, but if the user is exceeding the available uplink capacity the result is the same.
