Wayleave Authorization

My neighbour has signed up to Virgin and to connect the engineers will need to come across my drive which has been recently resurfaced so I want to talk to an engineer before any work is started. It is near on impossible to actually talk to someone as no replies to the emails I send mailto:residentialwayleave@virginmedia.co.uk

I am with Virgin myself so when I try to use the chat facility it just keeps talking about my account. Is there anyone out there that can help as my new neighbours are getting very frustrated as one of them wants to work from home.

    Before you agree to this, check to see if there is an alternative route for the cable that doesn't involve your drive. 

    The contractors that VM use to lay the cables will always use the quickest, cheapest route. If for instance your drive will save them digging a trench in the pavement they will always go for that.

    Bear in mind that the wayleave is permanent and will remain when you sell the house. It will likely be worded openly to let them do further work if they wish.

      That is my concern hence why I am not agreeing to it until I can instruct the engineer where they can dig , I have no issues with them following the line where my drive was patched into the private road which serves our 3 properties but as you say you just know they will dig up straight across my drive as it is the most direct route it is very frustrating for me and my neighbour.

    You won't know who will do the digging. Once VM instruct a contractor, even they will not know who will be sent.

    If the three houses all have legal access rights to the drive, VM will need wayleaves from all three. Have you discussed with the third house?

    In addition to the info from jpeg1, we have seen past topics on here where some carefully laid plans for cables have been agreed with a VM person in advance only for the cabling sub-contractor to turn up and do something totally different. The sub-contractors can turn up unannounced at any time so you may not be at home to supervise what they get up to.

    if VM is still using this, or similar, you should read all the T&Cs carefully as some of them are pretty onerous and not to the advantage of a third party neighbour.

    Understandable that you would want to keep on good terms with your neighbour but, once VM has the signed agreement, you will be at the whim of whatever VM or its sub-contractors choose to do.

      from other posts on here even if you agree something with an engineer or contractor at a site visit that can be ignored by the team that comes out to do the work - as said the wayleave is an open ticket to do what they want in the quickest-cheapest way possible - it might be frustrating but the longer term problems could be far worse
