since the last patch, Subtitles keep turning on for all my channels and I'm having to turn them off every time I change channel. is there a way to set them to a default setting as OFF?

Have you checked that subtitles are turned off, the setting can now be found under Accessibility, press Home>Settings>Accessibility.
