Hub 3 Trial - Terms and Conditions

This document outlines the terms and conditions which apply if you participate in Virgin Media Hub 3 trial. In consideration of the mutual promises set out in the terms and conditions, Virgin Media and the Participant agree to the following terms.

These Trial Terms and Conditions apply in addition to our TV, Fibre and Phone Terms and Conditions and any other terms and conditions applicable to your existing services, accessible here.

If there is any conflict between these Trial Terms and Conditions and any other terms and conditions these Trial Terms and Conditions will take precedence.

We may amend these Trial Terms and Conditions from time to time. If we do, we will send the most up-to date terms which will apply to you.

These Trial Terms and Conditions are made up of the following different parts:

 The Trial

  • The Trial includes the following:
    • the provision of firmware to a Hub 3
  • The Trial will last approximately between 4-12 weeks commencing on the day Virgin Media notifies you through the Community and ending on the date Virgin Media notifies You of the end of the Trial, on the Closed Community Trial Page (“Trial Period”).
  • On completion of the trial, a £30 Amazon Voucher will be sent to trialists who have completed an end of trial survey. The survey will be distributed on the Closed Community Trial Page.
  • The Trial is for your own personal use only.
  • You will not be able to obtain support for the Equipment or Services outside of the Closed Community Trial Page.
  • The Trial is only available to eligible participants to help us road-test our new Equipment and Services and give us their vital feedback so we can fine-tune our processes. Because of this, the Equipment and Services may not be fault free and are provided to you on an “as is” and “as available” basis. Therefore, to the extent permitted by law and regulation, we do not provide express or implied representations, warranties, guarantees or conditions in relation to the Equipment or Services provided under the Trial, including any Equipment or Services provided after expiry of the Trial without charge. We do not guarantee that the Equipment and the Services will:
    • be error-free or uninterrupted;
    • operate with other services, content, applications, software, hardware, systems, or data; or
    • meet your requirements or expectations.

Who can participate in the Trial

  • The Trial is available to (“Eligible Participants”). Existing Virgin Media customers with an active broadband service and who already have a Hub 3. Customers without a Hub 3 will not be eligible.
  • Eligible Participants who have applied to participate in the Trial, will be notified by Virgin Media in writing if they have been accepted onto the trial (a “Participant”).

Participation in the Trial

  • To request to participate in the Trial, within the dates communicated by us to you, Eligible Participants must successfully complete the Virgin Media Hub 5 and WiFi Pods Trial form provided by us to you here:  https://forms.office.com/e/bWrqp3ij9V
  • We will notify applicants who have been selected for the Trial via private message on the Community and will advise them of the next steps.
  • Once you have successfully completed the above steps, you will be sent the firmware to your Hub 3 and then you will gain access to the Closed Community Trial Page.

Feedback

  • The Trial is only available to Participants so they can help us road-test our new products before our commercial release. In return for providing the Equipment to you, you’ll be required to provide feedback throughout the experience so we find any improvements we should make and any glitches we need to fix.
  • Please give us any feedback you have on your experience using the Equipment and Services from your Community account on the Closed Community Trial Page.
  • We will also contact you via the Community to request feedback on your experience using the Equipment and Services as part of the Trial, which may include sending you surveys to complete.
  • You can contact us in relation to the Trial via the Closed Community Trial Page.
  • If you experience any difficulties with the Equipment or Services provided as part of the Trial, please let us know via the Closed Community Trial Page, however, note that we are under no obligation to correct any faults or issues that arise in relation to the Equipment or Services provided as part of this Trial.

Confidentiality

  • You must not speak to anyone about the Trial or its contents, outside of the closed area of the Closed Community Trial Page.
  • The Participant undertakes to Virgin Media that it shall:
    • keep the Confidential Information secret and confidential;
    • not use or exploit the Confidential Information in any way, except with Virgin Media’s prior written consent.
  • If requested by the Virgin Media at any time, the Participant shall immediately destroy or return to Virgin Media all Equipment, documents and other records of the Confidential Information or any of it in any form that have been supplied to or generated by the Participant. If the Confidential Information is stored in electronic form, the Participant shall permanently erase all such Confidential Information from its computer and communications systems and devices used by it.

General

  • This Agreement will end immediately upon Virgin Media’s notice to you that the Trial has ended.
  • Paragraphs 5, 1.3, 1.6 and 7 shall survive termination of that Agreement, for whatever reason.
  • We can make changes to the Trial Terms and Conditions at any time.  Any changes will apply from the date we publish them on the Closed Community Trial Page. The latest version of the Trial Terms and Conditions applicable to you will be available on our Closed Community Trial Page so please check regularly for updates.

Definitions

  • In this Trial Terms and Conditions:

"Agreement" means these Trial Terms and Conditions, the TV, Fibre and Phone Terms and Conditions and any other terms and conditions applicable to your existing services, accessible here (which includes our Privacy Policy and any other relevant terms specified by us);

Closed Community Trial Page” means a hidden area in the community, you’ll be private messaged on the community with instructions on how to access this area];

Community” means Virgin Media’s online platform at https://community.virginmedia.com/ where existing Virgin Media customers can signup to participate in discussion with other Virgin Media customers and get help from Virgin Media staff;

Confidential Information” means all confidential or proprietary information (however recorded or preserved) relating to this Trial (including the existence of the Trial) that is disclosed or made available whether before or after the date of this agreement (in any form or medium), directly or indirectly, by Virgin Media to the Participant.

Equipment” means the Virgin Media Hub 5 and WiFi Pods provided by us to you as part of this Trial;

Participant” or “You” means an existing Virgin Media customer with broadband only services, who has been accepted by Virgin Media onto the trial, in writing;

Services” means any services provided by Virgin Media to a Participant in relation to this Trial;

Trial” means the Virgin MediaHub 5 and WiFi Pods trial, as detailed in paragraph 1;

Trial Terms and Conditions” means these Virgin Media Hub 5 and WiFi Pods Trial Terms and Conditions, as amended;

"We", "us", "our" or "Virgin Media" means Virgin Media Limited, (Company Number 02591237) whose registered address is 500 Brook Drive, Reading, RG2 6UU;
