Virgin Media is a limited company, so they can be named on any legal claims.

Any court will expect you to have exhausted non-legal avenues first, which includes a CISAS/Ombudsman case.

They are not signed up to CISAS and can’t get any further with the ombudsman as even though they say that a failure to agree letter would be sent it has never been received. I have also written to them outlining my complaint including the written confirmation of the compensation that they owe me but I still after more calls and 5 months

Ombudsman Services are now VM's arbitration provider as of Jan 2023

Bit confusing as to whom you are referring in the post above.

If you have complained via the VM complaints process, and failed to get an acceptable resolution after 8 weeks, you can take the matter to arbitration in any event.

VM recently changed from using CISAS to Ombudsman arbitration - when did you reach the point of escalating your unresolved complaint externally?

You don't need a deadlock letter to escalate in either case, you can just wait 8 weeks from your complaint being raised - and potentially include the refusal to issue said letter, in the complaint.

The ombudsman won’t move forward unless a failure to agree letter has been sent by virgin media. Virgin media say they will send one but after 4 months never received by me. So can’t move any further with the ombudsman

That doesn't fit with the information regularly posted on here by people in the same boat. See first video at the link below (1:23 time stamp)

Which ombudsman have you been in touch with?

Hi there @Shackleton127

Thank you so much for your post and welcome to the community forums, it's great to have you here.

I am so sorry to hear that you have had a complaint with us, I'll be happy to look into this with you via a PM so we can see what we can arrange for you.

I will pop you a PM across now, please keep an eye out for the purple envelope in the top right corner of your screen alerting you to a new message.

Don't wait so long. If you cannot resolve your complaint via the Communications Ombudsman and you think Virgin Media (Limited) owe you money, why not try taking them to a small claims court. Will be pleased to hear the outcome.
