£65 Activation fee for Broadband upgrade?!

I have been reading a bit about the reasons behind Virgin's 'activation fees', and some are dubious but kind of understandable - such as the reinstatement of a disconnected landline now having to route through the latest Hub rather than re-use the original cable connection.

I was suprised to see in 'My Offers' that I could go from M200 to M350 broadband with an otherwise unchanged TV and phone package for les than £1.50 per month...but this would also incur a £65 fee without any change of equipment or engineer visit. Do I realistically have any grounds to contest this charge?
