My neighbour has just had a new drive laid & fence fitted between our properties. His virgin media broadband cable had to be dug up and relaid. However the cables have been fed under the fence into my front garden and out through my front wall onto the pavement.I didn't give permission for any of this and I would like them moved back onto my neighbours property. I will shortly be having my front drive done but can't because the cables are in the way.

wayleave - as far as i know is not transferable - so if it was granted in the past and you bought the property then VM have no right of access without a new wayleave but that is my understanding so you would need to check
that said if the cable was fully on your neighbours property in the past and with the work they have had done that was not easy it seems to me the tech has just found an easy answer - why bother to ask you - just do it and leave - thats how it works - search on here to find other examples
staff here will refer it to the local area field manager who may do something or may ignore you and hope you go away - it comes down to you and your neighbour really and what you hope for - if it can be buried on your property then thats an easy solution if not then you need to insist something is done but you might find that an uphill struggle
looking at the photo again there is something odd - the green tube which seems not to be used is VM that feeds under something - there also looks to be a joint in the cable again thats odd - is that area your garden in which case it would look to have been there before

Thanks Tony, I will speak to my neighbour. I am having a new drive later on in the year. Whose responsibility would it be if my contractor, when digging up my drive, were to cut through the cable. Would I have to pay to get it fixed?

nothing to do with you or your neighbour - VM would have to sort it and all fault repairs are free- VM might argue that if it needs moving now it would be a non fault call out and thats £25 but your neighbour is not going to complain and it should not be crossing your land so that really would not apply
if it was just a lazy tech taking the easy route VM should move it - but the keyword is SHOULD - getting them to do it is a whole different matter
vm dont come to this part of the forum much so will flag the thread and get them to have a look
