over utlization

My internet is ridiculously slow between 2 and 8mb at busy times an engineer has been out and confirmed its over utilisation and work will be done on the 28 of dec. I have phoned and received an discount. Which I need to do every month till its fixed ? ,I have now been told I will be January Before it's fixed or they move it back again? to a later date I am not happy as his is not why I signed up with virgin my online gaming has suffered as it not fast enough can I cancel my contract with them now as I don't receive what they claim one very unhappy virgin customer.
