It’ appears when I am watching live tv. Anywhere within the service from the guide to watching catch up to live tv. I can’t voice search at all.

Just to clarify that, the message appears without you pressing the voice control button.
If that's the case I would say your remote either has a sticky voice control button or is faulty.

Have you tried new batteries or rebooting the 360?
