went for upgrade, virgin set up new contract not upgrade. now paying two contracts for 1 phone

entitled to mobile upgrade. went for iphone 5s. virgin did not upgrade me but set up new contract. now have 2 contracts for 1 phone. tried phoning after long call to india they told me to write in. how do i get this rectified, are virgin doing this all the time?
