mobile phone replacement

Sent my htc one m8 in for repair and have been told AFTER I rung back that it needs to be replaced but can't be given a time frame. It's been nearly two weeks after phoning up loads of times they still can't tell when. I have been told that it's a fault with Virgin software. Can some please advise what I should do

Request they refund you the time spent without your phone. I'm not saying this is going to achieve anything but I would not want to be paying for something I have not got.
