Are you using cable for your tests or wireless?

and you're still getting 40mb on cable. Does this only happen at certain times?

Also be mindful of the speed test sites your using, many are designed for ADSL testing and not super fast cable.

One of the best places you can test against is probably speedtest.net and setting the server to names co london, which is known to be able to do the business

Usually use speedtest.net to London. Have been doing speed tests throughout the day and again averaged about 40.
