Unadopted Roads

If all house oweners living on an unadopted road agree to NOT GIVE permission for Virgin to work in their road, can Virgin override the wishes of the house ownrs and proceed anyway, under their remit as a statutory service provider ?

As someone who co-owns the freehold of a large private estate with an unadopted access road I would say it is down to the owner / freeholder of said road to have the final say.  If he or she says 'No' then any attempt by VM to install on private property would be illegal in my opinion.

Unadopted roads have nothing to do with homeowners, it is as it says unadopted, these roads are still looked after by local council thus VM would probably notify them to say they are working on these roads without objection from the council!

Our unadopted road which serves nearly 40 properties is not looked after by the council.  

Definition: "An unadopted road (or a private road) is a road that is not maintained by a highway authority as defined by Highways Act 1980. ... The responsibility of maintaining the unadopted road then falls upon the landowner or landowners, usually a private individual, company or organisation."

Cable companies have only ever had agreements with local authorities to install in adopted roads. Unadopted or private roads were canvassed at the time of build & were only included if the owners agreed. This is still the case.
